Please read these Terms of Service ("Terms") carefully, as they govern your access to and use of Enchanto AI ("we," "our," or "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not access or use our Service.

1. Service Description

Enchanto AI provides an online platform that uses artificial intelligence technology to help users generate virtual toy character images based on text descriptions. Our services include but are not limited to:

Generating AI toy character images based on user text prompts
Providing user account systems to save and manage generated images
Offering different subscription plans and credit systems
Allowing users to download, share, and display generated images

We reserve the right to modify, suspend, or terminate the Service or any part of it at any time without notice.

2. Account Registration and Security

To use certain Service features, you may need to create an account. You agree to provide accurate, complete, and up-to-date information, and to keep your information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you discover any unauthorized use or security breach, please notify us immediately.

We reserve the right to refuse service, terminate accounts, or remove or edit content without notice at our sole discretion.

3. User Content and Conduct

When you create content using our Service (including text prompts and generated images), you retain all rights to the content you create. However, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, copy, modify, create derivative works, distribute, publicly display, and otherwise exploit your content for the purpose of providing and improving our Service.

You agree not to use our Service to create or share:

Content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
Content that infringes on the intellectual property rights of others
Content containing viruses, malware, or other harmful code
Content used to distribute spam, deceive or defraud users
Content that interferes with or disrupts the Service or servers and networks connected to the Service

We reserve, but do not assume, the obligation to remove any content we deem to violate these Terms.

4. Intellectual Property

Our Service and its contents (excluding user-provided content) are our property and are protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or lease any part of our Service.

For images you generate using our Service, we grant you a non-exclusive, worldwide, royalty-free license to use, copy, modify, create derivative works, display, perform, and distribute these images for personal and commercial purposes, subject to the following limitations:

You may not claim AI-generated images were created by a human
You may not use the images for illegal or harmful purposes
You may not use the images in a way that could harm our reputation
You may not use the images in products that directly compete with our Service

5. Payments and Subscriptions

Certain Service features may require purchasing subscription plans or credits. All payments are final and non-refundable unless required by law or otherwise specified at our discretion.

Subscriptions automatically renew unless you cancel at least 24 hours before the renewal date. You may manage your subscription at any time in your account settings.

We reserve the right to change prices at any time, and will provide notice of any price changes via email or in-Service notification. Continued use of the Service will constitute your acceptance of any new fee structure.

6. Disclaimer

Our Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that results will be accurate or reliable.

You understand and agree that your use of the Service is at your own risk. We are not responsible for any content, goods, or services obtained through our Service.

7. Limitation of Liability

To the maximum extent permitted by law, we and our subsidiaries, affiliates, officers, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses.

Our total liability for any damages resulting from your use of or inability to use our Service will not exceed the amount paid by you to us for using the Service during the 12 months preceding the event giving rise to the liability, or 100 CNY (whichever is greater).

These limitations do not apply to damages arising from our gross negligence, willful misconduct, or fraud, or where applicable law does not permit such limitations.

8. Indemnification

You agree to indemnify, defend, and hold harmless us and our subsidiaries, affiliates, officers, agents, partners, and employees from any claim, damage, obligation, loss, liability, cost or debt, and expense (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any part of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your user content caused harm to a third party. This defense and indemnification obligation will survive these Terms and your use of the Service.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law principles.

If any dispute arises between you and us, we both agree to first try to resolve the dispute informally. If that is not possible, you and we agree to resolve any dispute through the relevant courts of Beijing with exclusive jurisdiction.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any significant changes by posting the updated Terms on our website or through other communications. Your continued use of the Service after such changes are posted will constitute your acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to the Service without prior notice or liability for any reason, including, but not limited to, your breach of these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or notify us through our contact channels.

12. General Terms

Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.

Waiver and Severability: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. If any provision of these Terms is held to be invalid by a court, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions, and the other provisions of these Terms remain in full force and effect.

Assignment: You may not assign or delegate these Terms or your rights or obligations under these Terms without our prior written consent. We may freely assign these Terms without restriction.
